Refund Policy

1. Overview

We want you to be satisfied with our services. This Refund Policy explains when and how refunds are available for each tier. Tiers 1 and 2 are software products. Tier 3 is a legal service governed by the Indiana Rules of Professional Conduct, including Rule 1.5 (Fees).

2. Tier 1 — Eligibility Analysis Software ($99)

2.1 Full Refund

You will receive a full refund if:

  • The software fails to produce a report within 24 hours of payment;
  • You request a refund within 7 days of purchase AND no report has been generated by the software;
  • We later determine, in our sole discretion, that we cannot serve you appropriately.

2.2 No Refund After Report Generation

Once the software has generated your report, no refund is available, except as provided in Section 2.3 below. The software has rendered its product. Tier 1 is a software product (not a legal service), comparable to other online software-based eligibility tools.

2.3 Software Defects

If you believe the software produced a defective report (for example, a software malfunction caused incorrect output), contact jason@spindlerlaw.com within 30 days of purchase. We will review and, if confirmed, regenerate the report at no additional cost or refund the fee — at our discretion.

3. Tier 2 — Self-Service Document Generation ($399)

3.1 Full Refund

You will receive a full refund if:

  • You request a refund within 7 days of purchase AND no documents have yet been generated by the software.

3.2 No Refund After Document Generation

Once documents are generated by the software, no refund is available. The software has rendered its product. Tier 2 is a software product — comparable to LegalZoom or similar services — and refunds are not available simply because you choose not to use the documents the software produced.

3.3 Quality Issues

If you believe the documents contain a defect (e.g., a software malfunction caused incorrect output), contact us at jason@spindlerlaw.com. We will review and, if confirmed, regenerate the documents at no additional cost.

4. Tier 3 — Attorney-Prepared Petition ($1,299)

4.1 Full Refund

You will receive a full refund if:

  • We decline to take your case (for example, because we anticipate a hearing will be required);
  • You cancel within 24 hours of purchase AND before the Zoom consultation has been scheduled;
  • We fail to file your petition within 14 days of the Zoom consultation, due to our delay (not yours).

4.2 Pro-Rated Refund

If you cancel after the Zoom consultation but before the petition has been drafted, you may receive a partial refund equal to the unearned portion of the fee, in accordance with Indiana Rule of Professional Conduct 1.5 (Fees) and Rule 1.16 (Termination).

4.3 No Refund After Substantive Work

Once we have begun substantive work — defined as both (a) the Zoom consultation has occurred AND (b) the petition has been drafted — no refund is available, except as required by Indiana Rule of Professional Conduct 1.5.

4.4 If a Hearing Is Set

If a court sets a hearing on your petition, our representation ends automatically as described in the Tier 3 Engagement Agreement. No refund is available because the work we performed was complete regardless of the hearing outcome.

5. How to Request a Refund

Submit your request in writing to jason@spindlerlaw.com. Include:

  • Your full name;
  • The email address used at purchase;
  • The tier purchased and date of purchase;
  • The reason for the request.

We will respond within 7 business days. Approved refunds are processed back to the original payment method within 7-14 business days.

6. Court Filing Fees

Court filing fees paid to courts on your behalf are NOT refundable by us. The court controls those fees. If you wish to seek refund of a court filing fee, you must contact the court directly.

7. Chargebacks

Before initiating a chargeback through your bank or card issuer, please contact us first at jason@spindlerlaw.com. We will work in good faith to resolve any concerns. Initiating a chargeback without first contacting us may result in additional administrative fees and may affect future eligibility for our services.

8. Modifications

We may modify this Refund Policy. The current policy at the time of your purchase governs that purchase.

9. Indiana Rules

For Tier 3 (the only tier involving attorney representation), refunds are also subject to the requirements of the Indiana Rules of Professional Conduct, including Rule 1.5 (Fees) and Rule 1.16 (Termination of Representation). Where any term of this policy conflicts with those Rules, the Rules govern.
